Divorce and Property

Divorce not only terminates the legal partnership between two spouses, but can also require that the property previously shared by the couple be divided. While property owned by either spouse prior to the marriage can remain the property of the original owner, most things acquired after the wedding (community or marital property) and before separation are often subject to division upon divorce. This section includes resources to help those going through a divorce determine how property should be divided, what happens to shared debts, how to find hidden assets, what happens to the family home, the effect on insurance policies, and more. A marital property division checklist and a sample property settlement agreement form also are included.

Community Property vs. Equitable Distribution

There are two main systems for dividing marital property: equitable distribution and community property. While the majority of states use equitable distribution, the community property states are larger and thus about a third of the U.S. population lives under these states, including California and Texas. Community property states split marital property evenly, while equitable distribution states will give the higher earning spouse a larger share than the lower earning spouse, such as a stay-at-home parent. Debt and Marital Property

Debts from the marriage have to be divided among the spouses as well. Sometimes, debts may be associated with only one partner, such as gambling debts. In this case, the court can divide the debts appropriately to the wrongdoer. Typically, household or general expenses debts will be divided evenly. Even some seemingly separate debts, like student loans to one spouse whose career benefited the marriage, may be divided evenly to each spouse, depending on the state. Taxes, Retirement Funds, Inheritances, and Divorce

You’ll want to understand how taxes are affected by your divorce, particularly in the year that you divorce. In addition, your retirement funds and other estate planning tools may need to be divided to compensate the spouse without an IRA. You may need a special court order called a “QDRO.” To learn more, read the Divorce, Taxes, and your Estate Plan article.

Inheritances are generally considered separate property and are therefore exempt from the division of property between spouses, see Inheritance and Divorce below.

Property Settlement Agreements

Property settlement agreements can be amicably entered into between former spouses to avoid drawn out court proceedings in a divorce. The judge will review it for equity, but as long as it’s fair enough, it’s typically granted. If both you and your ex can agree to a particular division of property, then it may be in your interest to settle your marital property issues outside of court. The sample property settlement agreement here is a great place to start.

Getting Legal Help

Because your marital property will be divided in accordance with your state laws if you divorce, you should consider entering into a prenuptial agreement with your spouse before marrying, especially if either of you expect to earn a significant income. If you’re getting divorced, you may want to speak with a divorce attorney about your marital property options, including drafting your own settlement agreement with your ex. A licensee who remains on inactive status for more than two consecutive biennial licensure cycles and who wishes to reactivate the license may be required to demonstrate competency to resume active practice by sitting for a special purpose examination or by completing other reactivation requirements.

The current licensure biennium: 03/01/17 – 02/28/19. Current licenses expire at midnight, Eastern Time, on February 28, 2019 .

First Biennium Renewal: Occupational Therapists and Occupational Therapy Assistants renewing a license for the first time and were licensed in the second half of the biennium (on or after 03/01/18) are exempt from general continuing education. You are required to complete 2 hours in prevention of medical errors and 1 hour of HIV/AIDS. For the HIV/AIDS 1 hour (for first renewal only) requirement, the board approves any course approved by any of the professions regulated within the Division of Medical Quality Assurance, the Department of Health.

Continuing education hours can only be credited after one is licensed and within the current biennium dates in which they are taken.

Occupational Therapists and Occupational Therapy Assistants renewing a license for the first time and were licensed in the first half of the biennium (03/01/17 – 02/28/18) are required to complete all 26 as stated above, including the HIV/AIDS 1 hour (for first renewal only) requirement. The board approves any course approved by any of the professions regulated within the Division of Medical Quality Assurance, the Department of Health.

Even though you were required to complete a 2 hour course in prevention of medical errors for initial licensure purposes (if licensed before July 1, 2018), you must complete an additional 2 hours of prevention of medical errors for each renewal.

Other Methods of Obtaining Continuing Education per Biennium

  • Up to 5 hours per biennium: Development or Participation in Practice-Related Research Project and Learning through Alternative Media (video, audio, software programs)
  • Up to 6 hours per biennium: Level II OT/OTA Field Work Experience Supervision and Volunteer Expert Witness Service
  • Up to 8 hours per biennium: Course Presentations and Attendance at Board meetings
  • Up to 10 hours per biennium: Publications Related to Occupational Therapy Practice
  • Up to 1 – 10 hours per biennium for Publications. A licensee may earn the following continuing education credit for publication of a peer-reviewed or non peer-reviewed book, chapter, or article directly related to the practice of occupational therapy:
    • Up to 10 hours as the author of a book;
    • Up to 5 hours as author of a chapter;
    • Up to 3 hours as author of a peer-reviewed article;
    • Up to 1 hour as author of a non peer-reviewed article; and
    • Up to 5 hours as an editor of a book; Documentation shall consist of a full reference for the publication including title, author, editor, and date of publication. See 64B11-6.001 (12), F.A.C.
  • Up to 4 hours per biennium: Performance of Pro Bono Services to the indigent as provided in Section 456.013(9), F.S. or to underserved populations, or in areas of critical need within the state where the licensee practices. In order to receive credit under this rule, licensees must make a request to the Board and receive approval in advance. One (1) hour credit for each two (2) hours worked. See 64B11-6.001 (15), F.A.C.
  • Live vs. Home Study CEs. A minimum of fourteen (14) of the twenty-six (26) CE hours required for licensure renewal must be “live”. Live CE includes approved face-to-face course presentations and interactive, real-time courses that may be web-based, satellite transmitted, hosted via telephone or video conference, or an online instruction program that allows or requires the licensee to interact in real time, including live chat, with the instructor during the presentation of the program. Presentations that do not contain the real-time ability to communicate with the instructor would fall under the “home study” category.
  • No more than 12 hours of home study courses are allowed. Home study education is independent study and requires a certificate of completion. Home study education does not include a web-based, satellite transmitted or on-line instruction program that allows or requires the licensee to interact or communicate back and forth with the instructor during the presentation of the program.
  • The Board s measurement for Continuing Education hours is by contact hours. One (1) contact hour equals a minimum of fifty (50) minutes. One half (1/2 or .5) contact hours equals a minimum of twenty-five (25) minutes.
    For Occupational Therapist and Occupational Therapy Assistants the Florida Department of Health and the Florida Medical Association (FMA) collaborated to design a Healthiest Weight: A Life Course Approach and offer a FREE 3 hour Continuing Education/ Continuing Medical Education (CE/CME) course that can be accessed through TRAIN Florida .Once on the TRAIN Florida website, use your login information or, if you do not have an account, click create account and then login. The course can be accessed either by searching by title DOH Healthiest Weight: A Life Course Approach or course ID 1053825. After you complete the course, TRAIN Florida requires an Assessment and Evaluation be completed for submission to CE Broker for continuing education credit.

Human activities are responsible for almost all of the increase in greenhouse gases in the atmosphere over the last 150 years. 1 The largest source of greenhouse gas emissions from human activities in the United States is from burning fossil fuels for electricity, heat, and transportation.

    EPA tracks total U.S. emissions by publishing the Inventory of U.S. Greenhouse Gas Emissions and Sinks . This annual report estimates the total national greenhouse gas emissions and removals associated with human activities across the United States.

    The primary sources of greenhouse gas emissions in the United States are:

    • Electricity production (29 percent of 2015 greenhouse gas emissions) – Electricity production generates the largest share of greenhouse gas emissions. Approximately 67 percent of our electricity comes from burning fossil fuels, mostly coal and natural gas. 2
    • Transportation (27 percent of 2015 greenhouse gas emissions) – Greenhouse gas emissions from transportation primarily come from burning fossil fuel for our cars, trucks, ships, trains, and planes. Over 90 percent of the fuel used for transportation is petroleum based, which includes gasoline and diesel. 3
    • Industry (21 percent of 2015 greenhouse gas emissions) – Greenhouse gas emissions from industry primarily come from burning fossil fuels for energy, as well as greenhouse gas emissions from certain chemical reactions necessary to produce goods from raw materials.
    • Commercial and Residential (12 percent of 2015 greenhouse gas emissions) – Greenhouse gas emissions from businesses and homes arise primarily from fossil fuels burned for heat, the use of certain products that contain greenhouse gases, and the handling of waste.
    • Agriculture (9 percent of 2015 greenhouse gas emissions) – Greenhouse gas emissions from agriculture come from livestock such as cows, agricultural soils, and rice production.
    • Land Use and Forestry (offset of 11.8 percent of 2015 greenhouse gas emissions) – Land areas can act as a sink (absorbing CO2 from the atmosphere) or a source of greenhouse gas emissions. In the United States, since 1990, managed forests and other lands have absorbed more CO2 from the atmosphere than they emit.

    Emissions and Trends

    Since 1990, U.S. greenhouse gas emissions have increased by about 4 percent. From year to year, emissions can rise and fall due to changes in the economy, the price of fuel, and other factors. In 2015, U.S. greenhouse gas emissions decreased compared to 2014 levels. This decrease was largely driven by a decrease in emissions from fossil fuel combustion, which was a result of multiple factors including substitution from coal to natural gas consumption in the electric power sector; warmer winter conditions that reduced demand for heating fuel in the residential and commercial sectors; and a slight decrease in electricity demand.

    Larger image to save or print. The Electricity sector involves the generation, transmission, and distribution of electricity. Carbon dioxide (CO2 ) makes up the vast majority of greenhouse gas emissions from the sector, but smaller amounts of methane (CH4 ) and nitrous oxide (N2 O) are also emitted. These gases are released during the combustion of fossil fuels, such as coal, oil, and natural gas, to produce electricity. Less than 1 percent of greenhouse gas emissions from the sector come from sulfur hexafluoride (SF6 ). an insulating chemical used in electricity transmission and distribution equipment.

    Greenhouse Gas Emissions in the Electricity Sector by Fuel Source

    Coal combustion is generally more carbon intensive than burning natural gas or petroleum for electricity. Although coal accounted for about 70 percent of CO2 emissions from the sector, it represented only about 34 percent of the electricity generated in the United States in 2015. Another 32 percent of electricity generated in 2015 was generated using natural gas, an increase relative to 2014. Petroleum accounted for less than 1 percent of electricity generation in 2015. The remaining generation in 2015 came from non-fossil fuel sources including nuclear (about 20 percent) and renewable sources (about 13 percent), which include hydroelectricity, biomass, wind, and solar. 1 These other sources usually release fewer greenhouse gas emissions than fossil fuel combustion, if any emissions at all.

    Emissions and Trends

    In 2015, the electricity sector was the largest source of U.S. greenhouse gas emissions, accounting for about 29 percent of the U.S. total. Greenhouse gas emissions from electricity have increased by about 4 percent since 1990 as electricity demand has grown and fossil fuels have remained the dominant source for generation.

Therefore, it is possible to attribute the greenhouse gas emissions from electricity production to the sectors that use the electricity. Looking at greenhouse gas emissions by end-use sector can help us understand energy demand across sectors and changes in energy use over time.

    When emissions from electricity are allocated to the end-use sector, industrial activities account for a much larger share of U.S. greenhouse gas emissions. Emissions from commercial and residential buildings also increase substantially when emissions from electricity are included, due to their relatively large share of electricity consumption (e.g. lighting and appliances).

    Reducing Emissions from Electricity

    There are a variety of opportunities to reduce greenhouse gas emissions associated with electricity generation, transmission, and distribution.
